Welcome to PeerShots. These Terms of Service ("Terms") govern your use of the PeerShots mobile application and website (the "Service") operated by PEERSHOTS LLC ("PeerShots," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use PeerShots. If you are under 18, you must have parental or guardian consent. By using the Service, you represent that you meet these requirements. We reserve the right to require age verification at any time.

2. Account Registration

• You must provide accurate, current, and complete information during registration.
• You are responsible for safeguarding your password and for all activity under your account.
• You may not use another person's account without permission.
• You may not create accounts for the purpose of violating these Terms or our content policies.

3. User Content

3.1 Your Content

You retain ownership of content you post ("User Content"). By posting content, you grant PeerShots a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute your content solely for the purpose of operating and promoting the Service. This license ends when you delete your content, except where copies have been shared by others or are retained for legal compliance.

3.2 Content Standards

You agree not to post content that:

• Is illegal, threatening, harassing, defamatory, or obscene
• Infringes on intellectual property rights of others
• Contains malware, viruses, or harmful code
• Depicts minors in sexual or exploitative contexts (zero tolerance — immediate ban and law enforcement referral)
• Constitutes spam, scams, or fraudulent schemes
• Violates any applicable law or regulation

3.3 Content Moderation

We reserve the right to review, remove, or restrict access to any content that violates these Terms. Content may be auto-hidden after receiving 5 or more reports. We may suspend or terminate accounts that repeatedly violate our content policies.

4. Creator Monetization

4.1 Subscriptions

Creators may offer subscription-based access to exclusive content. Subscription pricing is set by the creator. Subscriptions are billed through Apple App Store or Google Play Store in-app purchases, or through Stripe for web-based subscriptions.

4.2 Pay-Per-View (PPV) & Content Unlocks

Creators may set individual prices for premium content. Purchases are non-refundable once content has been accessed. Pricing is set by the creator within platform-defined ranges.

4.3 Tips

Users may send tips to creators as a voluntary show of appreciation. Tips are non-refundable.

4.4 Revenue Split

Creators receive 97% of net proceeds from subscriptions, PPV purchases, and tips processed through Stripe. PeerShots retains 3% as a platform fee. For in-app purchases, Apple and Google take their standard commission (typically 15-30%) before the revenue split applies.

4.5 Creator Payouts

Creator payouts are processed through Stripe Connect. Creators must complete identity verification and provide valid banking information through Stripe. Payout timing is subject to Stripe's standard processing schedule (typically 2-7 business days). PeerShots is not responsible for delays caused by Stripe or the creator's financial institution.

4.6 Minimum Amounts

• Minimum subscription price: $4.99/year
• Minimum tip amount: $2.00
• PPV content: $0.99 – $49.99

5. In-App Purchases

Certain features of the Service are available through in-app purchases processed by Apple App Store or Google Play Store. These transactions are subject to the terms and refund policies of the respective app store. PeerShots does not process or store payment card information for in-app purchases. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel subscriptions through your device's app store settings.

6. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Impersonate any person or entity
• Interfere with or disrupt the Service or its infrastructure
• Attempt to gain unauthorized access to other accounts or systems
• Scrape, crawl, or use automated means to access the Service without permission
• Circumvent content access controls (paywalls, subscriptions, PPV locks)
• Redistribute or resell content obtained through the Service without the creator's explicit permission
• Use the Service to distribute unsolicited commercial messages (spam)

7. Reporting & Blocking

You may report content or users that violate these Terms using the in-app reporting feature. You may block users from your profile and content. We review reports and take action as appropriate, including content removal, account warnings, suspensions, or permanent bans.

8. Intellectual Property

The PeerShots name, logo, and all related marks are trademarks of PEERSHOTS LLC. The Service and its original content (excluding User Content) are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

9. Account Deletion

You may delete your account at any time through the app (Settings → Delete Account). Upon deletion:

• Your personal information is anonymized
• Active subscriptions to your content are cancelled
• Your subscriptions to other creators are cancelled
• Your content is removed from public view
• Pending payouts will be processed per Stripe's schedule

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE ARE NOT RESPONSIBLE FOR THE ACCURACY, QUALITY, OR LEGALITY OF USER CONTENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEERSHOTS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless PEERSHOTS LLC and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including attorney's fees) arising from your use of the Service, your User Content, or your violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in San Diego County, California.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms and updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
